Terms & conditions

1) Definitions

In these Terms & Conditions (“Terms”):

We/Us/Our: the operator of allvinyl.nl (see Section 2).

You/Your: the consumer purchasing on our website.

Goods: the products we sell, including but not limited to record cabinet(s), LP furniture, vinyl storage, record shelf units, LP accessories and related items.

Made-to-order Goods: Goods manufactured or assembled to your specifications (e.g., dimensions, finishes, configurations).

Contract: the sales contract concluded between you and us following an order confirmation.

Working day: Monday to Friday, excluding public holidays at our place of business.

3) Scope and territories

3.1 These Terms apply to consumer purchases made on www.allvinyl-platenkasten.nl.

3.2 We deliver to the Netherlands, Germany, Belgium and Denmark (see Delivery Terms).

3.3 For business (B2B) purchases, different terms may apply by written agreement.

 

4) Formation of the contract

4.1 Product listings are invitations to treat and not binding offers.

4.2 By placing an order at checkout you submit an offer to purchase.

4.3 The Contract is formed when we send an order confirmation by email.

4.4 We may refuse an order (e.g., obvious pricing error, suspected fraud, unavailability). Any amounts paid will be refunded without undue delay.

 

5) Prices, taxes and accuracy

5.1 Prices are shown in EUR, including VAT where applicable. Delivery charges and any optional services are shown separately before checkout.

5.2 We aim for accuracy but errors may occur. In case of an obvious and unmistakable pricing error that you could reasonably have recognised as such, we may cancel the Contract and refund you.

5.3 Promotional prices are valid only during the stated period and while stocks last.

 

6) Payment

6.1 Payment is due at checkout via the methods offered on the website.

6.2 We remain owner of the Goods (retention of title) until full payment has been received.

6.3 If payment fails or is reversed, we may suspend delivery and seek recovery of the Goods or the outstanding amount.

 

7) Delivery, risk and inspection

7.1 Delivery options, territories and lead times are described in our Delivery Terms, which form part of these Terms.

7.2 Unless otherwise agreed, if no specific delivery time is set, we will deliver within 30 days of the Contract date.

7.3 Risk passes to you when you or a third party designated by you (other than the carrier) physically receives the Goods.

7.4 On delivery, check the packaging and Goods. In case of visible transport damage, note it with the driver (where possible) and notify us without undue delay with photos. This does not limit your statutory rights.

 

8) Right of withdrawal (consumers)

8.1 For stock Goods, you have a 14-day right of withdrawal from the day you receive the Goods, in accordance with Directive 2011/83/EU (Consumer Rights Directive) as implemented in your country.

8.2 To exercise this right, notify Customer Service within 14 days of delivery. After notification you have 14 further days to return the Goods.

8.3 Made-to-order Goods are excluded from the right of withdrawal under Article 16(c) of Directive 2011/83/EU. We clearly indicate this before you place an order and on the product page.

8.4 Returns must be sent back undamaged, complete and resaleable; you may handle the Goods only to the extent necessary to establish their nature, characteristics and functioning (as in a shop).

8.5 You bear the costs of return shipment (see Return & Refund Policy). If the Goods have been used beyond permitted handling, we may deduct any diminished value from your refund.

8.6 After we receive and inspect the return, we refund the purchase price (and standard delivery cost, if paid) within 3 working days to your original payment method.

 

9) Conformity, legal guarantees and defects

9.1 We are under a legal duty to supply Goods that are in conformity with the Contract.

9.2 If the Goods are not as described, not fit for the purposes for which goods of the same type are normally used, or do not show the quality and performance which are normal and which you may reasonably expect, you may be entitled to remedies under the EU Sale of Goods rules (notably Directive (EU) 2019/771 as implemented).

9.3 In case of lack of conformity appearing within the statutory period, contact us promptly with details and photos. Where applicable we will arrange repair or replacement within a reasonable time and without significant inconvenience. If repair or replacement is impossible or disproportionate, you may request a price reduction or rescission (refund).

9.4 These statutory guarantees are in addition to any manufacturer warranty.

 

10) Product information, assembly and use

10.1 Dimensions, capacities (e.g., approximate LP counts), finishes and technical data are provided for guidance and may vary within normal tolerances for furniture.

10.2 Unless explicitly included, assembly and installation are not part of delivery. Follow any assembly instructions and use appropriate wall-fixings or anti-tip devices where supplied or reasonably required.

10.3 Record storage furniture is heavy. Ensure adequate floor loading and safe placement. We are not liable for damage caused by improper assembly, misuse, or failure to follow instructions.

 

11) Limitation of liability

11.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under mandatory law.

11.2 Subject to 11.1, we are not liable for: (a) indirect or consequential loss; (b) loss of enjoyment, data, or profits; (c) costs arising from improper installation or misuse.

11.3 Subject to 11.1 and your statutory rights, our aggregate liability arising out of or in connection with the Contract shall not exceed the total price paid for the Goods giving rise to the claim.

 

12) Force majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control (e.g., natural events, strikes, transport disruptions, pandemics, government measures). We will inform you without undue delay and take reasonable steps to mitigate. If performance is substantially affected for an extended period, you may terminate the Contract and receive a refund for undelivered Goods.

 

13) Returns procedure and refunds

13.1 The detailed process and conditions for returns and refunds are set out in our Return & Refund Policy, which forms part of these Terms.

13.2 Do not return Goods without prior contact; we will provide return instructions, the correct return address and packing guidance.

 

14) Environmental considerations

To reduce avoidable transport and emissions, we may ship orders directly from the manufacturer when suitable. We encourage careful size and capacity planning for your record cabinet or vinyl storage, to minimise unnecessary returns and failed deliveries.

 

15) Data protection and privacy

15.1 We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable national law.

15.2 For details on purposes, legal bases, retention, recipients and your rights (access, rectification, erasure, restriction, portability, objection), see our Privacy Policy.

15.3 We use appropriate technical and organisational measures to protect your data. You may contact us at any time regarding data protection questions.

 

16) Intellectual property

All content on the website, including product descriptions, images, graphics, logos and layout, remains our or our licensors’ intellectual property. You may not copy, modify or use it for commercial purposes without prior written consent.

 

17) Complaints and dispute resolution

17.1 If you have a complaint, contact Customer Service first. We aim to resolve issues within a reasonable time.

17.2 You may also use the European Online Dispute Resolution (ODR) platform for consumer disputes. Participation in ADR/ODR is on a voluntary basis unless otherwise required by law.

17.3 These Terms are governed by the laws of the Netherlands, without prejudice to the mandatory consumer protection rules of your country of residence within the EU. Disputes may be brought before the competent courts of your habitual residence or of our domicile, as mandated by EU law.

 

18) Changes to the terms

We may update these Terms to reflect legal, technical or business changes. The version in force at the time of your order applies to that Contract. The current Terms are available on our website with the date of last update.

 

19) Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision will be replaced by a valid one that best reflects the original intent.
